Once a Year Training on Sexual Harassment Prevention Required

A new Illinois requires that every employer with one employee or more to provide a sexual harassment prevention training program. Employers may create their own program that must meet minimum State standards or they can use the model sexual harassment prevention program created by the Illinois Department of Human Rights (“IDHR”).

The training must be provided at least once a year to all employees. Failure to conduct the training may result in penalties up to $5,000 per infraction (based on the number of employees and repeated offenses).

Illinois Law Requirements For the Sexual Harassment Program

Illinois requires that the sexual harassment prevention training program must include, at a minimum, the following:

(1) an explanation of sexual harassment consistent with the law;

(2) examples of conduct that constitutes unlawful sexual harassment;

(3) a summary of relevant federal and State statutory provisions concerning sexual harassment, including remedies available to victims of sexual harassment; and

(4) a summary of responsibilities of employers in the prevention, investigation, and corrective measures of sexual harassment.
